1. Introduction

Welcome to GEOflux ("we," "our," or "us"), a platform operated by Madison Agency SRL, a company registered in Romania. These Terms and Conditions ("Terms") govern your access to and use of the GEOflux website (https://geoflux.ai) and our AI Visibility Intelligence platform (the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

GEOflux is a SaaS (Software as a Service) platform designed to provide AI Visibility Intelligence. In its current state, the Service enables users to:

  • Monitor "Share of Voice" across various Large Language Models (LLMs) like ChatGPT, Gemini, and Perplexity.
  • Analyze brand visibility compared to competitors.
  • Identify sources and citations used by AI models.

Disclaimer regarding AI Outputs: You acknowledge that the data provided by GEOflux is derived from third-party Artificial Intelligence models. We do not control these models. GEOflux measures and reports on these outputs but does not guarantee specific rankings, recommendations, or sentiments from third-party AI providers. The Service is an analytics tool, not a guarantee of marketing performance.

3. User Accounts and Registration

To access the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the Service.

You are responsible for all activities that occur under your account. Madison Agency SRL reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Subscription, Free Trial, and Payments

4.1. 14-Day Free Trial

We offer a 14-day free trial to new users who register for the Service. The trial period begins immediately upon account activation.

  • No Charge During Trial: You will not be charged during the 14-day period.
  • Automatic Conversion: Unless you cancel your subscription before the end of the 14-day trial period, your account will automatically convert to a paid subscription, and the payment method provided will be charged for the applicable subscription fee.

4.2. Pricing and Plans

The Service is offered under various subscription plans. Current pricing and features for each tier are available on our website. We reserve the right to modify pricing with reasonable notice to active subscribers.

4.3. Billing and Invoicing

Payments are processed via third-party payment processors. Invoices will be issued by Madison Agency SRL. By subscribing, you authorize us to charge your payment method for the applicable fees.

4.4. Cancellation and Refunds

You may cancel your subscription at any time via your account settings.

  • Effect of Cancellation: If you cancel, your access will continue until the end of the current billing cycle.
  • No Refunds: As this is a B2B service, payments are non-refundable, and we do not provide credits for partially used periods, except where required by mandatory law.

5. Intellectual Property Rights

5.1. Our IP

All rights, title, and interest in and to the Service (including our software, algorithms, "GEO" methodologies, visual interfaces, logos, and code) are and will remain the exclusive property of Madison Agency SRL and its licensors.

5.2. Your Data

You retain all rights to the specific data and reports generated for your brand within your account, subject to our right to use aggregated and anonymized data to improve our Service.

6. Acceptable Use Policy

You agree not to misuse the Service. You must not:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to violate any applicable laws or regulations.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Sell, resell, rent, or lease the Service to a third party without our written consent.
  • Use the Service for "scraping" or bulk data extraction outside of the provided API limits or export features.

7. Data Protection and Privacy (GDPR)

Your privacy is important to us. Our collection and use of personal information are governed by our Privacy Policy.

By using the Service, you consent to the processing of your data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679.

  • Data Controller: Madison Agency SRL acts as a Data Controller for your account information.
  • Data Processor: For any data you upload or process through the system regarding third parties, Madison Agency SRL acts as a Data Processor.

8. Warranties and Disclaimers

  • "AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Madison Agency SRL makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein.
  • No Guarantee of Results: We do not warrant that the use of the Service will result in increased brand visibility, sales, or specific business outcomes. The nature of Generative AI is volatile and unpredictable; our data is a snapshot of that reality.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Madison Agency SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts in Bucharest, Romania.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
